Off-site use A copy of the Products may be given to a Service Bureau or Printer provided; the Service Bureau or printer also has a license to use the Products; or an additional written license grants this right.EmbeddingProducts may be embedded into electronic documents on unlicensed CPUs provided that;a) electronic documents are distributed in a form that allows only printing and previewing but does not allow editing of the text in any way or;b) electronic documents are for personal and or internal business use only;If performance of the Products cannot be restricted to print and view only, the Products may only be used on licensed CPUs. User may transfer the Product to an outside agency such as commercial printer providing that person or organisation has also purchased a licence to use the Product on the commensurate number of CPUs.Other rights Distributor and its suppliers retain title and ownership in the Products (including the transfer media) and documentation which is protected by United Kingdom copyright and design right law. Except where stated above this agreement confers no intellectual property rights or ownership including but not limited to copyright and trade marks.TermThis license remains in effect until terminated by Distributor at any time for its own legal reasons or if End User fails to comply with this agreement. End User may terminate this agreement at any time by returning all Products and documentation, Distributor not being liable for any indemnity or refund. Limited liability Any limited or implied warranties are effective for a period of 60 (sixty) days from proof of delivery date. Products should be free from errors in normal use. If the Products fails to comply with this warranty, Distributor will, at its own cost, replace defective media or refund the license fee except if misuse has caused the failure. Distributor will not warrant the performance of Products or documentation. If End User fails to prove the Product was obtained from an authorized source, the Distributor shall have no responsibility to correct any faults. The foregoing states the sole extent of Distributor's breach of warranty and makes no warranties covering third party rights. Liability Under no circumstances will Distributor be liable to any party for any consequential, incidental or indirect damages, including loss of business, profits or information, interruption of business, etc., arising from use or misuse of the Products whether known or advised. The above limitations may not apply in certain jurisdictions of the world. Acknowledgment End User has read and acknowledged this agreement which supersedes all previous statements of agreement between End User and Distributor and agrees to be bound by its terms. Unter Lizenzelementen werden im Sinne dieser Lizenz die folgenden bergeordneten Lizenzcharakteristika verstanden, die vom Lizenzgeber ausgewhlt wurden und in der Bezeichnung der Lizenz zum Ausdruck kommen: Namensnennung, Weitergabe unter gleichen Bedingungen. 5. Der Lizenzgeber im Sinne dieser Lizenz ist diejenige natrliche oder juristische Person oder Gruppe, die den Schutzgegenstand unter den Bedingungen dieser Lizenz anbietet und insoweit als Rechteinhaberin auftritt. 6. Rechteinhaber im Sinne dieser Lizenz ist der Urheber des Schutzgegenstandes oder jede andere natrliche oder juristische Person oder Gruppe von Personen, die am Schutzgegenstand ein Immaterialgterrecht erlangt hat, welches die in Abschnitt 3 genannten Handlungen erfasst und bei dem eine Einrumung von Nutzungsrechten oder eine Weiterbertragung an Dritte mglich ist. 7. Der Begriff Schutzgegenstand bezeichnet in dieser Lizenz den literarischen, knstlerischen oder wissenschaftlichen Inhalt, der unter den Bedingungen dieser Lizenz angeboten wird. Das kann insbesondere eine persnliche geistige Schpfung jeglicher Art, ein Werk der kleinen Mnze, ein nachgelassenes Werk oder auch ein Lichtbild oder anderes Objekt eines verwandten Schutzrechts sein, unabhngig von der Art seiner Fixierung und unabhngig davon, auf welche Weise jeweils eine Wahrnehmung erfolgen kann, gleichviel ob in analoger oder digitaler Form. Soweit Datenbanken oder Zusammenstellungen von Daten einen immaterialgterrechtlichen Schutz eigener Art genieen, unterfallen auch sie dem Begriff Schutzgegenstand im Sinne dieser Lizenz. 8. Mit Sie bzw. Ihnen ist die natrliche oder juristische Person gemeint, die in dieser Lizenz im Abschnitt 3 genannte Nutzungen des Schutzgegenstandes vornimmt und zuvor in Hinblick auf den Schutzgegenstand nicht gegen Bedingungen dieser Lizenz verstoen oder aber die ausdrckliche Erlaubnis des Lizenzgebers erhalten hat, die durch diese Lizenz gewhrten Nutzungsrechte trotz eines vorherigen Verstoes auszuben. 9. Unter ffentlich Zeigen im Sinne dieser Lizenz sind Verffentlichungen und Prsentationen des Schutzgegenstandes zu verstehen, die fr eine Mehrzahl von Mitgliedern der ffentlichkeit bestimmt sind und in unkrperlicher Form mittels ffentlicher Wiedergabe in Form von Vortrag, Auffhrung, Vorfhrung, Darbietung, Sendung, Weitersendung, zeit- und ortsunabhngiger Zugnglichmachung oder in krperlicher Form mittels Ausstellung erfolgen, unabhngig von bestimmten Veranstaltungen und unabhngig von den zum Einsatz kommenden Techniken und Verfahren, einschlielich drahtgebundener oder drahtloser Mittel und Einstellen in das Internet. 10. Vervielfltigen im Sinne dieser Lizenz bedeutet, mittels beliebiger Verfahren Vervielfltigungsstcke des Schutzgegenstandes herzustellen, insbesondere durch Ton- oder Bildaufzeichnungen, und umfasst auch den Vorgang, erstmals krperliche Fixierungen des Schutzgegenstandes sowie Vervielfltigungsstcke dieser Fixierungen anzufertigen, sowie die bertragung des Schutzgegenstandes auf einen Bild- oder Tontrger oder auf ein anderes elektronisches Medium, gleichviel ob in digitaler oder analoger Form. 11. Mit Creative Commons kompatible Lizenz bezeichnet eine Lizenz, die unter http://creativecommons.org/compatiblelicenses aufgelistet ist und die durch Creative Commons als grundstzlich zur vorliegenden Lizenz quivalent akzeptiert wurde, da zumindest folgende Voraussetzungen erfllt sind: Diese mit Creative Commons kompatible Lizenz 1. enthlt Bestimmungen, welche die gleichen Ziele verfolgen, die gleiche Bedeutung haben und die gleichen Wirkungen erzeugen wie die Lizenzelemente der vorliegenden Lizenz; und 2. erlaubt ausdrcklich das Lizenzieren von ihr unterstellten Abwandlungen unter vorliegender Lizenz, unter einer anderen rechtsordnungsspezifisch angepassten Creative-Commons-Lizenz mit denselben Lizenzelementen, wie sie die vorliegende Lizenz aufweist, oder unter der entsprechenden Creative-Commons-Unported-Lizenz.2. Abwandlungen des Schutzgegenstandes zu verffentlichen, ffentlich zu zeigen und zu verbreiten. 5. Bezglich Vergtung fr die Nutzung des Schutzgegenstandes gilt Folgendes: 1. Unverzichtbare gesetzliche Vergtungsansprche: Soweit unverzichtbare Vergtungsansprche im Gegenzug fr gesetzliche Lizenzen vorgesehen oder Pauschalabgabensysteme (zum Beispiel fr Leermedien) vorhanden sind, behlt sich der Lizenzgeber das ausschlieliche Recht vor, die entsprechende Vergtung einzuziehen fr jede Ausbung eines Rechts aus dieser Lizenz durch Sie. 2. Samuelstype End User License AgreementEnd user licensing terms:The Font Software is licensed for use at one (1) location with a maximum of five (5) devices.Using the Font Software at more than one (1) location or with more than five (5) devices requires a Multi-Device Site License upgrade. A device is defined as a computer, printer, character generator, server or any other machine that uses font data to rasterize letterforms.Upon completion of job a service bureau, if involved, must delete the font software or purchase their own license.Except as permitted herein, you may not modify, adapt, translate, reverse engineer, decompile, disassemble, alter or otherwise copy the Font Software.You are permitted to make a single back-up copy. The Font Software may not be sublicensed, sold, leased, rented, lent, or given away to another person or entity.The Font Software may be returned or exchanged only if defective. Defective software will be replaced when accompanied by a valid sales receipt and Samuelstype is notified within two weeks of purchase.Embedding of the Font Software in any form is strictly prohibited without an additional license.The Font Software is protected under domestic and international trademark and copyright law. You agree to identify the Samuelstype fonts by name and credit the Samuelstype ownership of the trademarks and copyrights in any design or production credits.This Agreement is effective until terminated. This Agreement will terminate automatically without notice from Samuelstype if you fail to comply with any provision contained herein. Upon termination, you must destroy the written materials, the Font Software, and all copies of it, in part and in whole, including modified copies, if any.Samuelstype makes no warranties, express or implied as to merchantability, fitness for a particular purpose, or otherwise. Without limiting the foregoing, Samuelstype shall in no event be liable to the Licensed user or any other third party for any direct, indirect, consequential, or incidental damages, including damages from loss of business profits, business interruption, loss of business information, arising out of the use or inability to use the product even if notified in advance. Under no circumstances shall the Samuelstype liability exceed the replacement cost of the Software.Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

This is a contract between you and Parachute Worldwide , a corporation established and operating according to the laws of Greece (Parachute). Subject to the terms and conditions hereof and upon payment of the license fee Parachute grants you a non-exclusive, non-assignable, non-transferable right to use the Parachute font software (font software). This is not an agreement for sale of the font software or any portion or copy of it.Font Software. The font software you selected for purchase, is the property of Parachute and/or its suppliers. The term font software is referred to the computer program which contains digitally encoded scaleable outline font data and includes any related documentation, updates, permitted modifications and permitted copies of the font software licensed to you by Parachute. You agree that Parachute and/or its suppliers own all rights to the font software and its structure, selection, organization and code, including copyrights, patents, design and trademark rights. In addition, you agree that the code and structure of the font software constitute and contain valuable trade secrets owned by Parachute and/or its suppliers. The font software is protected by International Copyrights Laws.Standard User License. You may install the Font Software on up to 5 (five) workstations at the same location. Workstation is referred to any device by which an individual is able to make use of the font software. You may not duplicate or copy the font software except as needed to use it as expressly permitted by this Agreement. However, you may make one (1) copy of the font software for backup purposes. All permitted copies you make must contain the exact copyright, trademark and other proprietary notices that appear on and/or in the font software. You may install the Font Software on a single local network only when the use of the font software is limited to the workstations which are part of this license . If you wish to use the font software at more than one (1) location or with more than five (5) workstations you must acquire a multi-device site license upgrade at an additional cost.Modifications. You agree that you will not modify, add new functionalities, adapt, translate, reverse engineer, decompile, decrypt, disassemble nor create derivative works of the font software without Parachute's prior, express written consent. Derivative work is referred to any font software which is derived or based upon the hereto licensed font software binary data (or any portion of it).Embedding. Embedding of the font software into electronic documents or internet pages is only permitted in a secured read-only mode. Licensee must ensure that recipients of electronic documents or internet pages cannot extract the font software from such documents or use the embedded font software for editing purposes or for the creation of new documents.Transfer/Service Bureau/Printer. You may not sell, lend, otherwise transfer or sublicense the font software to any third party without Parachute's prior written consent. You may send a copy of the font software, or any portion of the font software, used in your documents to a commercial printer or service bureau to enable the editing or printing of your documents, provided that such commercial printer or service bureau has purchased a valid license to use the font software.Other Restrictions. You agree that you may not use the font software or portion of it (unless you obtain additional licensing) for purposes other than those licensed under this Agreement. In particular you may not use the font software or portion of it in the following:A. as part of a copyrighted logo or trademarkB. as part of interactive software such as video gamesC. as part of electronic templates such as website design templates and presentation templates which an individual can use to create electronic greeting cards, business cards, e-business cards, or any other electronic or printed matterD. as part of a commercial product when the font software becomes the primary aspect for resale (for example on plain t-shirts or coffee mugs, where the main element used to sell the product is the image of letters which is stamped on it)Termination. The license granted hereunder shall automatically terminate, if you fail to comply with the terms and conditions hereof. Upon termination of this font software License Agreement, you agree to either return or to destroy and refrain from using the font software, the media, copies and/or any modified or merged portions thereof.Limited Warranty. For a period of 90 days after delivery, Parachute warrants that the font software will perform as outlined in the user documentation in effect at the time of the commencement of this license. Parachute will undertake reasonable commercial efforts to correct substantial malfunctions occurring during this warranty period provided that such malfunctions are reproducible, your product is properly registered, and you give immediate notice in writing and sufficient detail of such malfunctions to Parachute. PARACHUTE'S SOLE LIABILITY AND YOUR EXCLUSIVE REMEDY WITH RESPECT TO BREACH OF THE FOREGOING LIMITED WARRANTY WILL BE LIMITED TO ERROR CORRECTION OR PRODUCT REPLACEMENT. Such corrections generally will be incorporated into new revisions of the font software, or until the release of such new revisions into temporary versions, at Parachute's discretion.EXCEPT FOR THE ABOVE EXPRESS LIMITED WARRANTY, THE FONT SOFTWARE IS HEREUNDER LICENSED AS IS, AND PARACHUTE MAKES NO OTHER WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE REGARDING THE FONT SOFTWARE. PARACHUTE SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.The font software is nonreturnable and nonrefundable.Limitation of Liability. UNDER NO CIRCUMSTANCES SHALL PARACHUTE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING IN ANY WAY OUT OF THIS AGREEMENT OR THE USE OF THE FONT SOFTWARE, HOWEVER CAUSED, (WHETHER ARISING UNDER A THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE), INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA OR BUSINESS INFORMATION, OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES ARISING OUT OF THE USE OR INABILITY TO USE THE FONT SOFTWARE EVEN IF NOTIFIED IN ADVANCE. UNDER NO CIRCUMSTANCES SHALL PARACHUTE'S LIABILITY EXCEED THE REPLACEMENT COST OF THE FONT SOFTWARE.Third Parties. You agree to inform your employees or any other person having access to the font software and copies thereof, of the terms and conditions of this font software License Agreement and to ensure that they shall strictly abide by these terms and conditions.General. Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter of this Agreement and supersedes all prior and contemporaneous written and oral agreements between the parties regarding the subject matter of this Agreement. No waiver or modification of this Agreement will be binding upon either party unless made in writing and signed by a duly authorized representative of such party and no failure or delay in enforcing any right will be deemed a waiver.Severability. If any provision of this Agreement is found to be illegal or unenforceable, the other provisions shall remain effective and enforceable to the greatest extent permitted by law.Assignability. Except as otherwise provided in this Agreement, you may not sell, assign or delegate any rights or obligations under this Agreement. Any attempted assignment in violation of this Agreement shall be void and without effect.Governing Law. This Agreement shall be governed by and construed in accordance with the laws of Greece. All disputes related to this Agreement shall be heard in the Court of Law of the City of Athens, Greece.
